Tearing Off and Beginning Again
OFFICIAL RULES

1. NO PURCHASE NECESSARY TO ENTER OR WIN.

2. ELIGIBILITY. This drawing (the “Drawing”) is open only to legal residents of the United States of America who are at least 18 years of age. Employees, officers and directors of The Solomon R. Guggenheim Foundation (“SRGF”), Davler Media Group (Davler Media), their advertising and promotion agencies, and their respective immediate families (or persons living in their same households) are not eligible to win.  This Drawing is void where prohibited by law and subject to all federal, state, and local laws and regulations.  Participation in this Drawing constitutes full and unconditional acceptance of these Official Rules and agreement to be bound by all decisions of SRGF and Davler Media (the “Organizers”) with respect to the Drawing.  You must have access to the Internet and a valid e-mail address in order to enter the Drawing.
3. HOW TO ENTER ONLINE. Entries into the Drawing may be made by visiting the thoughtgallery.org page at: https://thoughtgallery.org/ticket-giveaway-guggenheim-museum and completing the online entry form, including your name and a valid email address, between the hours of 10 am on Wednesday October 9, 2013 and noon on October 18, 2013, EDT.  Organizers reserve the right to disregard any entry that is incomplete or incorrect.  All entries become the property of Organizers. Entries are limited to one (1) entry per person and per email address; anyone who enters multiple times will be disqualified.

4. PRIZE. Two general admission tickets to Tearing Off and Beginning Again, October 22, 2013 ($24)

Prizes are nontransferable and cannot be exchanged for cash.  There can be no substitutions for a prize. Any taxes due as a result of winning a prize, and the payment of any other expenses or incidentals not specified herein, are the sole responsibility of the winner.

5. SELECTION AND NOTIFICATION OF WINNER.
Organizers will select a winner by conducting a random drawing on or about October 18, 2013 from all eligible entries received by the entry deadline.  The winner will be notified by email.  If the winner does not respond to notification by email within twenty four (24) hours, or if any prize or notification is retruned as undeliverable, an alternate winner will be selected from the remaining eligible entries received. The winner must collect the tickets at the Solomon R. Guggenheim Museum, 1071 Fifth Avenue, New York, NY 10128 before 7:30 pm on the date of the selected event.  The winner agrees that Organizers may use his or her name, photo and likeness for publicity purposes without further compensation or consideration.

6. ODDS OF WINNING. The odds of winning the prize are dependent on the total number of eligible entries received.

7. RELEASE. By participating in the Drawing, each entrant releases SRGF, Davler Media, their advertising and promotion agencies, and their respective affiliates, trustees, directors, officers, employees, representatives, and agents from any and all liability for any claims, costs, injuries, losses or damages of any kind arising out of, resulting from, or in connection with (i) the Drawing, including any technical or Internet malfunctions or human error of any kind which may occur in the processing of entries in this Drawing, (ii) the acceptance, possession or use of any prize, and (iii) any claims based on publicity rights and merchandise delivery.

8. GENERAL CONDITIONS. Organizers are not responsible for incorrect or inaccurate entry information, whether caused by Internet users or by any of the equipment or programming associated with or utilized in the Drawing or by any technical or human error which may occur in the processing of the entries in this Drawing. If for any reason the Drawing is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes which corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Drawing, Organizers reserve the right, in their sole discretion, to cancel, terminate, modify or suspend the Drawing.

Organizers reserve the right, in their sole discretion, to disqualify any entrant found to be (1) tampering or attempting to tamper with the entry process or the operation of the Drawing; (2) violating the Official Rules; or (3) acting in an unsportsmanlike or disruptive manner, or with the intent to annoy, abuse, threaten or harass any other person. Any false information provided within the context of the Drawing by any entrant concerning identity or email address and/or non-compliance with Official Rules may result in the immediate elimination of the entrant from the Drawing. Organizers further reserve the right to disqualify any entry that they believe, in their sole discretion, infringes or violates the rights of any third party or otherwise does not comply with the Official Rules.  CAUTION: ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE COMPETITION MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS. SHOULD SUCH AN ATTEMPT BE MADE, SPONSORS RESERVE THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.

9. GOVERNING LAW. The Drawing is governed by and construed and enforced in accordance with the laws of New York State, without regard to its choice of law provisions. Any case, controversy, suit, action, or proceeding arising out of, in connection with, or related to this Drawing shall be brought in federal or state court located in New York County and the State of New York.  By participating in the Drawing, the entrant hereby consents to the jurisdiction of these courts. Any and all claims, judgments, and awards shall be limited to actual damages.

10. USE OF INFORMATION. By entering the Drawing (i) you agree that your entry and any other personally identifiable information collected or used in connection with the Drawing may be used by the Organizers in accordance with the Privacy Policy posted at http://www.guggenheim.org/privacy-policy/ and (ii) you automatically opt-in to receive the Guggenheim Public Programs monthly newsletter.

That’s the question U.S. Circuit Judge Denny Chin has to decide, which will end an 8-year-old lawsuit by the Authors Guild and individual writers against Google Inc, owner of the largest search engine in the world.

Bloomberg: “‘Google has engaged in a massive campaign of bulk copying of books, which could adversely affect actual and potential markets for copyrighted books,’ authors said in a court brief.”
